The site  www.lessecretsdelo.fr  is a service of the company LES SECRETS D'ELO, creators and manufacturer of cosmetic products  bio, SARL, registered with the RCS of RODEZ under number 87917174200015 (Code APE: 2041ZZ). Headquarters: 566, rue de Cantaranne ZI de la Prade 12850 ONET LE CHATEAU (France).
These conditions apply to all sales made from this site, to the exclusion of all other conditions, in particular those in force for sales in stores or at home.  These conditions are not applicable to products sold on the sites of our partners. These general conditions are presented in French.

 

 

 

OBJECT

 

The general conditions of sale described below detail the rights and obligations of the company LES SECRETS D'ELO  and its client in the context of the sale of the following goods: natural and organic cosmetic products plus accessories for the use of these products.  Any order on this site implies the buyer's unreserved acceptance of these general conditions of sale, manifested by checking the box "I have read and I accept the general conditions of sale", before validation of its ordered.


PRODUCTS

The characteristics of the products offered for sale are presented in the “Our products” section of our site. All texts and images presented on the site of the company LES SECRETS D'ELO are reserved, for the whole world, under copyright and intellectual property rights. Their reproduction, even partial, is strictly prohibited.

 

DURATION

The products are offered for sale while stocks last. In the event of an order for a product that has become unavailable, the customer will be informed of this unavailability, as soon as possible, by e-mail or by post.



PRICE

The prices of the goods sold are those in effect on the day the order is taken. They are denominated in euros and displayed inclusive of all taxes, excluding shipping costs. The amount of VAT and shipping costs will be specified on the "Basket" page, as well as on the summary of the order before payment.  The company LES SECRETS D'ELO grants itself the right to modify its prices at any time. However, it undertakes to invoice the products ordered at the prices indicated when the order is recorded. The proposed rates include the discounts and rebates that the company  would have to grant. No discount will be granted for early payment.

 

 

 

VAT

In accordance with the legislation in force, the VAT collected on sales is transferred to France.



ORDERED

To place an order, the customer must create an account on the site, and provide all the personal information necessary for the processing and delivery of orders, as well as for preparing invoices (last name, first name, address, etc. -mail, phone). The ordering of products in the "Professionals" category is reserved for professionals (sector: Pharmacy, beauty, well-being). The name of the company must be indicated in the contact details of the customer account.  The customer validates his order when he activates the "Order" link at the bottom of the "Order" page after having accepted these conditions of sale. Before this validation, the customer is systematically offered to check each of the elements of his order. He can thus correct any errors.  The company LES SECRETS D'ELO  confirm the order by email. This information includes all the elements of the order and the customer's right of withdrawal. The data recorded by LES SECRETS D'ELO constitute proof of the nature, content and date of the order. This is archived by  LES SECRETS D'ELO under the legal conditions and deadlines. The customer can access this archive by contacting customer service.



PAYMENT TERMS

The payment of orders is made by:

- bank card (euro zone, secure payment by the PAYPAL module),

- check (mainland France) and

- bank transfer



DELIVERY

Orders are processed as quickly as possible, upon receipt of payment (+ eight (8) day credit check period for checks), Monday to Friday inclusive. The fastest way is to pay by credit card or SEPA transfer.
All products are shipped without any guarantee as to time, with the exception of shipments to individuals. The shipping deadline is the day of receipt of payment + eight (4) days (unless otherwise stated on the home page of the site).

Any risk of loss or damage to goods is transferred to the consumer when the latter or a third party designated by him, and other than the carrier proposed by the professional, takes physical possession of these goods.

The professional is legally responsible towards the consumer for the proper performance of the obligations resulting from the contract concluded at a distance, whether these obligations are performed by the professional who concluded this contract or by other service providers, without prejudice. of its right of recourse against them. However, he can be exonerated from all or part of his responsibility by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure.

When the consumer personally takes delivery of the objects transported and when the carrier does not justify having given him the possibility of actually checking their good condition, the period mentioned in Article L.133-3 of the Commercial Code which covers any action against the valet parking is increased to ten days.

RIGHT OF WITHDRAWAL AND RETURN

The Purchaser has a period of fourteen (14) clear days to inform LES SECRETS D'ELO of his wish to withdraw. This period starts from the day of receipt of the order. The Purchaser, to exercise this right of withdrawal, must within this period inform LES SECRETS D'ELO of his decision to withdraw by mail.  

The Buyer can use the withdrawal form available  here .

The Purchaser must then return, at its expense, the Product (s) in its (their) original packaging, at the latest within fourteen (14) days following the communication of its decision to withdraw, to the following address: LES SECRETS D'ELO - 566 RUE DE CANTARANNE 12580 ONET LE CHÂTEAU - FRANCE. Returned products must be accompanied by the downloadable withdrawal form above.

When the fourteen (14) day period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day. For reasons of hygiene and health, and in accordance with article L221-28 of the Consumer Code, Products which have been opened by the Purchaser after delivery may not be subject to a right of withdrawal. and therefore a refund.

If the aforementioned conditions are met, LES SECRETS D'ELO will reimburse the Purchaser for all sums paid by the Purchaser as soon as possible and at the latest within fourteen (14) days following the date on which LES SECRETS D'ELO has been informed of Buyer's decision to withdraw.  The reimbursement will be made according to the means of payment initially used by the Purchaser.

DISPUTES

These general conditions of sale are subject to French law.
LES SECRETS D'ELO cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, which could result from the misuse of the products sold.
In the event of a dispute, the customer should first contact the company LES SECRETS D'ELO to obtain an amicable solution.
If one or more of the clauses of these general conditions of sale are held to be invalid, void or inapplicable in application of a law, a regulation or a court decision, the other clauses will remain valid and will keep any their effectiveness.

The consumer can seize, either one of the jurisdictions territorially competent under the code of civil procedure, or the jurisdiction of the place where he lived at the time of the conclusion of the contract or the occurrence of the harmful event.

QUALITY GUARANTEE

The customer benefits from a guarantee of quality on the products. In the event of a defect on a product, the customer must contact customer service. If the defect is proven, LES SECRETS D'ELO undertakes to exchange or reimburse the defective or non-conforming products as soon as possible.

The provision of personal information collected in the context of distance selling is mandatory, this information being necessary for the processing and delivery of orders as well as for the preparation of invoices. This information is strictly confidential and is exclusively reserved for internal use.

LEGAL GUARANTEES

Before the consumer is bound by a contract for the sale of goods or the supply of services, the professional communicates to the consumer, in a legible and understandable manner, the following information:

LES SECRETS D'ELO products are guaranteed for 2 years according to the legal guarantee of conformity.  

The Buyer benefits from the legal guarantee of conformity (article L.217-4 and following of the Consumer Code) and defects in the item sold (article 1641 and following of the Civil Code).

In the event of non-compliance, the Purchaser may choose between replacing or reimbursing the Product (s), subject to the conditions provided for in Article L.217-9 of the Consumer Code.
